Terms of Service


Important Legal Agreements

Wild Web Hosting provides web hosting to clients worldwide, and we have a responsibility to protect each client and to provide the best services available. All clients of Wild Web Hosting are subject to the following terms of service:

Billing & Refunds

Services offered by Wild Web Hosting does not have any Refund Policy Due to nature of hosting industry and the costs involved with provisioning and maintaining your Service.

We accept PayPal, Payfast Credit/Debit Payments. There is no Minimum Contract Periods for any plans. In Case of any Disputes We are unable to offer any refunds its your responsibility to check our Services in the validity you buy for then decide whether to continue or not. Due to the nature of Business and service maintenance we don't offer any refunds, so all the sales made from Wild Web Hosting are final.

Acceptable Usage Policy

A. Examples of unacceptable material include: IRC Bots, Proxy Scripts, Anonymizers, Pirated Software, Warez, image hosting only sites that do not host an actual domain/normal website content, Escrow, High-Yield Interest Programs(HYIP), Bank Debentures ,Livechat/Chat Scripts, Download sites(Pirated softwares), Bank Debenture Trading Programs, and Prime Banks Programs, lottery sites, muds, rpg's, hate sites, hacker focused sites/archives/programs, sites promoting illegal activities,Flash Games or Online Gaming Sites,Movie's,MP3 Songs,File hosting. No refunds will be given.

B. We reserve the right to refuse service to anyone. Any material that in our judgment that is obscene or threatening is prohibited and will be removed from our servers with or without notice. Failure to respond to email from our abuse department within 48 hours may result in the suspension or termination of your services. If in doubt regarding the acceptability of your site or service, please contact us and we will be happy to assist you. No refunds will be given.

C. Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography (Lolita). Any site found to host child pornography or linking to child pornography will be terminated immediately without notice. We will also report this to the appropriate authorities. No refunds will be given.

D. Resellers: we will suspend the site in question and will notify you so you may terminate the account. We will further monitor your activity; more than one infraction of this type may result in the immediate termination of your account. No refunds will be given.

E. Direct customers: Your services will be terminated with or without notice. Violations will be reported to the appropriate law enforcement agency. No refunds will be given.

F. It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible.

Zero Tolerance Spam Policy

A. We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double opt-in" will be treated as spam. Any user who sends out spam will have their account terminated with or without notice. No refunds will be given.

B. Mailing Policy and Limits: Sending Bulk mails are not allowed on our server,Per cPanel account can send 100 Mails. If any accounts seems to be spamming it will be suspended with or without any notice (Only for shared, reseller, master reseller packages)

C. Any mailing list larger than 5,000 will require a semi dedicated or dedicated hosting solution from us. Note: dividing one large list into smaller lists to get below this limit is not allowed. No limit to the number of outbound emails.

D. Mailing Lists Rules: Anytime you are sending a message no matter how large your e-mail list is you must throttle it. We recommend you throttle it to at the very least sending 1 email every 6 seconds. If the mailing list software you are using does not allow you to throttle you must switch to something else. We recommend phplist which can be found in your control panel under Fantastico DeLuxe. If you do not throttle and you try sending let's say 60 emails the server will try sending all 60 in 1 second which is not possible. This will cause the server load to go very high and for the entire server to be sluggish until this process is completed. It is our job to keep the server up and running without being sluggish. Anyone who causes the servers load to go high will be suspended and the process will be terminated. If you choose not to throttle you will most likely be suspended for crashing the server. No refunds will be given.

E. You are not allowed to mail to a mailing list you were given or purchased. This is spamming because they never agreed to you personally sending them mail. We do not care how you justify it, this is spam and will result in termination of the offending account. No refunds will be given.

F. Any unsolicited e-mail being sent will result in termination of the offending account. We take a zero tolerance stance against sending of unsolicited e-mail. No refunds will be given.

* Backups and Data Loss Your use of the services rendered is at your sole risk. Wild Web Hosting is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backups of files and data stored on Wild Web Hosting servers. Your server may or may not have automatic backups installed. Servers that have automatic backups are generally done on Sunday. Backups can be made through cPanel/ Direct admin panel. The Daily/Weekly Backup we offer is just an complementary. So kindly have a copy of your files for safety purpose.

* Cancellations and Refunds Wild Web Hosting has the rights to cancel any account at any time with or without notice. Any abuse of our Terms of Service / Acceptable Use Policy /Privacy Policy and/or staff in any medium or format will result in the suspension or termination of your services. Customers may cancel at any time via a cancellation request in writing to the account services support department. Domain name purchases/renewals are non-refundable. All purchases from Wild Web Hosting are final. No refunds will be given.

Resource Usage (Not allowed)

A. Customer (you) may not use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
B. Any account is not allowed to use average system resources (CPU, RAM, MySQL) more than 2% in 24 hours cycle.
C. Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
D. Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
E. Run any software that interfaces with an IRC (Internet Relay Chat) network.
F. Run any bit torrent application, tracker, or client.
G. Participate in any file-sharing/peer-to-peer activities.
H. Run any gaming servers such as counter-strike, half-life, battlefield1492, etc... (dedicated servers do not apply)
I. Run cron entries with intervals of less than 15 minutes.
J. When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include ("http://yourdomain.com/include.php") use include("include.php")
K. Media hosting (i.e. audio , video etc), Backup hosting, Adult content hosting , Online Forum etc are strictly prohibited.

Migration Terms

Our Transfers Team will make every effort to help you move your website to us, however, transfers are provided as a courtesy service. We do not make any guarantees regarding the availability, possibility, or time required to complete an account transfer. Each hosting company is configured differently, and some hosting platforms save data in an incompatible or proprietary format, which may make it extremely difficult, if not impossible, to migrate some or all account data. In some cases we may not be able to assist you in a transfer of data from an old host. The free transfer service is available for thirty (30) days from your sign up date. Transfers outside of the thirty (30) day period will incur a charge; please contact a member of our Transfers department to receive a price quote. In no event shall Wild Web Hosting be held liable for any lost or missing data or files resulting from a transfer to or from Wild Web Hosting. You are solely responsible for backing up your data in all circumstances.

Other Terms

1. Uptime The uptime of a server is defined as the reported uptime from the operating system of the server which may differ from the uptime reported by individual services. Wild Web Hosting cannot 100% guarantee the uptime status of any server for many factors which may include but not limited to updates to software, malicious or intentional activities, hardware failure, acts of God defined as conditions beyond our (Wild Web Hosting and/or our vendors that provide equipment or services to us) control that interrupts services at a facility.

2. Reseller Client Responsibility Reseller clients of Wild Web Hosting are responsible for supporting their clients. Wild Web Hosting does not provide support to our Resellers Clients. If a Resellers client contacts us, we reserve the right to place the client account on hold until the Reseller can assume their responsibility for their client. We reserve the right to charge said Reseller for services rendered to the Resellers client. All support requests must be made by the Reseller on their clients behalf for security purposes. Resellers are also responsible for all content stored or transmitted under their reseller account and the actions of their clients. Wild Web Hosting will hold any reseller responsible for any of their clients actions that violate the law or Wild Web Hostitng Terms of Service / Acceptable Use Policy / Privacy Policy. If any Reseller account involved in doing Resource abuse or Unacceptable content abuse's Wild Web Hosting has rights to block the total Reseller since the accounts should maintain under the fair usage policy. Reseller's are responsible for their clients how the accounts are being hosted. If we receive multiple abuse reports the total Reseller will be blocked and 100$ Reactivation Fee should be paid to Reactivate the account.

3. Price Change - The amount you pay for hosting will never increase from the date of purchase for the term of contract (if said contract exists and is validated by Wild Web Hosting). Wild Web Hosting reserves the right to change prices for services at any time. Furthermore, we reserve the right to change prices listed on Wild Web Hosting, and the right to change the amount of resources given to any plan at any time.

4. Disclaimer Wild Web Hosting shall not be responsible for any damages your business may suffer. Wild Web Hosting makes no warranties of any kind, expressed or implied for services we provide. Wild Web Hosting disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Wild Web Hosting and its employees.

Disclosure to law enforcement Wild Web Hosting may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.

Fair Usage Policy

1. Unlimited disk space and bandwidth means there is no set limits on our packages. Wild Web Hosting want you to have the resources you need to build your site without any limits. But, however we do need to make sure we continue to provide a full active service to all our customers. As such we do require all customers to be fully compliant with our Fair Usage Policy and Terms and Conditions. Customers on unlimited hosting packages this includes but not limited to shared hosting packages. As a customer of Wild Web Hosting you agree to be subject to the following fair usage policy: The account will be primarily used for the purposes of web hosting. Unacceptable use includes, but are not limited to, large file storage and making downloads of large files such as but not limited to media files, zipped folders and programmed files. File downloads are permitted, but only in the context of a functioning website. The hosting account may not cause problems with performance of other hosting accounts hosted on the same server by making excessive demands on the resources of the server. This includes, but is not limited to, the CPU usage required to perform data processing on the account for the purposes of taking backups and other administrative tasks as well as the CPU usage required to actually serve the site on the hosting account. As a customer you agree that Wild Web Hosting will be determining whether an infringement of this 'fair use' policy has occurred. Wherever possible, Wild Web Hosting will propose alternative hosting arrangements should an infringement of this policy occur. These may include, but are not limited to, moving to a hosting plan with quoted disk space and bandwidth limits. If we identify an account that is not in compliance with our Fair Usage Policy or that has the potential to negatively impact the performance of our server, we will be required to temporary suspend the account. If this happens, we will work with the customer in order to resolve the issue as quickly as possible. Wild Web Hosting reserves the right to revise its policies at any time without notice. Before placing order, please read our terms / privacy policy / refund policy.

2. Every cPanel will be allocated with 100% CPU, RAM : Up to 1GB, IO & IOPS : Up to 1 GB. In Shared environment the sites should maintain the resource under the limit and MySQL query timing should not take long to process. If any accounts using more than the fair usage policy will be suspended and we can give single IP Address access for optimization

3. If any account doing abuse again and again. The corresponding account will be suspended and he/she should pay SECURITY Fee of 20$ (Non-Refundable)

4. There is no Refunds for any clients if they are Trying to do abuse from our network even the Service is used or not.. Domain registration/Hosting with Bank Names are Not allowed we will cancel the order(Even it was not used)

5. Late fee of 10% Will be added by our billing system if any invoice was not paid within the Due.

6.Any service suspended regarding Abuse like phising, Spamming, Scampages, Malware, Etc will be Cancelled in next 24 - 48 hours with/without Notification If Security Fee is not paid or client failed to respond.


7.If any Service is not paid even after the Due date our WHMCS System will delete the Account automatically With/Without Notification We are not Responsible for any Data's if the Due is not paid.


8.We are not providing any Refunds for Renewal Invoice's / Payments.


9.We Don't offer any Refunds for Order's which are under Promotional Code (Coupon Code) Even if its under 7 days money back Guarantee Timing.


10.If any client using abusive language (unwanted words or bad words) on any Support Methods like (Livechat, Email,Ticket, Whatsapp) We will terminate the client service's immediately Without any excuses. We are not responsible for the Data's inside your account.


11.Hosting Courier Site's are not allowed under our server. If hosted and notified by our Team We will suspend it. For unsuspension client he/she should send us the Company Registration proof, Identity Proof Provided by the Government After verification we will unsuspend the account. Failure of providing proof within the timeframe will held in service cancellation and no refunds.


12.According to our Mailing policy you are not allowed to send any spam/bulk emails in any of our services like Shared, Reseller, Master reseller and VPS Plans. We don't offer any refunds on Spam/Bulk emails. Port 25 has been blocked in all our VPS Servers Since All major providers are running ip6 to ipv4 tunnels for mail delivery outbound as well as running dual stack for inbound email (emails can be sent to thier IPv4 address and they will handle the delivery to the client on IPv6.


13.There is no refunds for Promo Hosting Plans even it was bought for 1 Year or 2 Year.


14.Providing Free hosting is not allowed for any Reseller's/Master/Alpha Reseller's. If provided the account will be Suspended and no refunds will be given. To reactivate your account The client should pay Reactivation fee for Resource Usage Of 15.00$(Non Refundable Payment) otherwise We will be terminating all the account under the WHM.

If you want to provide free hosting plans then vps or dedicated server is mandatory.


15.You are not allowed to create hosting with free domains like .tk .ga .ml .cf and other free domains. The numbers of abuse cases are increased with the use of free domains. If you want to host free domain you need to get approval from our abuse/security team.


16.All the accounts are suspended on the 5th Day from the Due date and it will be terminated in 8th day from the Due date. We are not responsible for any data loss if account has been terminated because of payment, we can help you to restore the backups only if available in backup server and it will be charged.


17.We have rights to terminate our reseller's client accounts, if they were suspended over a month or if they did not obey our terms, to save our server resources.


18.We have Rights to Change our Policies/Rules anytime with/without any Notification. You(Client) Can check our Policy pages for any updates

 

WEBSITE DESIGN

Terms of Service

The purpose of this Agreement (hereafter referred to as the “Agreement”) is to precede a a understanding of obligations between  both parties, under which Company will provide Web Design services on behalf of Client.


BY TICKING THE TICK BOX UPON PURCHASING A SERVICE YOU THE CLIENT AGREES TO THESE TERMS & CONDITIONS.


WHAT DO THE PARTIES AGREE TO?

As our customer, you have the power and ability to enter into this contract on behalf of your company or organization. You agree to provide us with everything that we’ll need to complete the project including text, images and other information as and when we need it and in the format we ask for. You agree to review our work, provide feedback and approval in a timely manner too. Deadlines work two ways and you’ll also be bound by any dates that we set together. You also agree to stick to the payment schedule set out at the end of this contract. Wild Web Hosting & Designs has the right to take up to 35 Business days to complete the website if any technical issues may arise. Especially when Wild Web Hosting & Designs have to use special billing software integrations, or apps like zappier. We have the experience and ability to perform the services you need from us and we will carry them out in a professional and timely manner. Along the way we will endeavor to meet all the deadlines set but we can’t be responsible for a missed launch date or a deadline if you have been late in supplying materials or have not approved or signed off our work on-time at any stage. On top of this we’ll also maintain the confidentiality of any information that you give us.

DESIGN & DEVELOPMENT

We’ll create designs for the look-and-feel, layout and functionality of your web site. This contract includes one main design plus the opportunity for you to make up to five rounds of revisions. If you’re not happy with the designs at this stage, you will pay us in full for all of the work that we have produced until that point and you may either terminate this contract or continue to commission Wild Web Designs to produce further design revisions at the hourly rate set forth within this scope.

HTML5 & CSS LAYOUT TEMPLATES

If the project includes HTML markup and CSS templates, we’ll develop these using HTML5 and CSS2.1 and CSS3 for styling. The landscape of web browsers and devices changes regularly and our approach is to look forward, not back. With that in mind we will test all our markup and CSS in current versions of all major desktop browsers to ensure that we make the most from them. Users of older or less capable browsers or devices will experience a design that is appropriate to the capabilities of their software. For people using Microsoft Internet Explorer 6, this means a universal, typographically focused design but no layout. We will also test that these templates perform well on Apple’s iPad. We will not test old or abandoned browsers, for example Microsoft Internet Explorer 5 or 5.5 for Windows or Mac, previous versions of Apple’s Safari, Mozilla Firefox or Opera unless otherwise specified. If you need us to consider these older browsers, we will charge you at the daily rate set out in our original estimate for any necessary additional design work, development and testing.


COPY WRITING: COPY & CONTENT

The task of creating copy is one that resides with the business owner or a representative that knows the business best. Much can be taken from current documents you may have already developed, whether its a business plan, yearly reports, or a current website. As a brand agency, we are highly capable or producing fresh creative brand centric search focused copy for your startup website, or rebranding campaigns. Some companies steal copy from competitors websites and change out the titles. This method is referred to in the industry as scraping content and is highly discouraged as most always detected by Google's duplicate content algorithms and leads to a decrease in your websites search ranking. We'll be happy to help provide you with fresh, brand centric, search optimized copy writing for your business outsourcing with a preferred provider, but in terms of site development and structure, we’re currently not responsible for writing or inputting any text copy within the scope of this agreement unless you have selected  to use our outsourcing option and you have received a quotation for this. For more specific details please ask us about this option. 

CHANGES & REVISIONS

We know from plenty of experience that fixed-price contracts are rarely beneficial to you, as they often limit you to your first idea about how something should look, or how it might work. We don’t want to limit either your options or your opportunities to change your mind. The estimate/quotation prices within this document are based on the amount of time that we estimate we’ll need to accomplish everything that you have told us you want to achieve. If you do want to change your mind, add extra pages or templates or even add new functionality, that won’t be a problem. You will be charged the hourly rate set out in the estimate we gave you. We ask that you submit any change requests in writing through the comments section of the our invoicing software so we can keep track of changes.

TECH SUPPORT SERVICES

3 Month Service Warranty - Included with purchase of a new website. We agree to provide commercially reasonable technical support and assistance to maintain and update the deliverables, including correcting any errors for up to 3 months after site launch. This warranty service shall not include the development of "enhancements" to the project or other services outside the scope of this proposal. Any additional support needs shall be covered by a separate agreement, or billed for at the hourly rate that is in effect upon the date of the request for additional support. 

Service Warranty Limitations.

Our service warranty is specific to the site software that we employ for your particular project. We can provide you with hosting on our dedicated server, or we will be happy to work with your current hosting. We will charge you a one-off fee (included in this estimate) for installing your website on any specified server, plus any software outlined within this scope, but after initial setup, any support issues that arise from hosting issues will be between you and your hosting service provider. If you select Wild Web Hosting & Designs as your hosting provider, the hosting service warranty is separate from this agreement and covered in the details of that contract. We are highly capable and always happy to provide you with assistance in troubleshooting outside hosting solutions or any DNS complications, but please be aware that you will be billed per our hourly consulting rate at the time of service request. 

Extended Maintenance Programs 

Upon expiration of your website’s included 3 month warranty service period and at your option, Wild Web Hosting & Designs can provide additional technical support services for a monthly fee of: See our websites for the monthly maintenance plans pricing. You may extend the monthly maintenance period at any time upon mutual written agreement and purchase. Please be aware that extended maintenance only covers reasonable support requests if your website goes down, or if you mess something up and need us to repair something or request minor changes and updates to plugins and theme templates. Please see list of services that is included in the maintenance plans below. Any consulting to help with the marketing of your website or produce external listings, or search related campaigns for increased website traffic or increased conversions is not covered within an extended maintenance package.• Add Content / Pages: Add new pages to your site• Social Media Integration: Add your latest social content, new social buttons

• Update Content: Update Latest News, Blog Posts, Articles, Videos, Images

• Image Re-sizing: Re-size images for page speed optimization

• Optimize: Optimize Page Speed, Mobile Layouts, User Experience

• Site Health & Performance Scans: Scan your site for site health issues and implement updates

• Website Backups - which is not kept on your hosting site - and have to use space on our hard drives for backups. We only make one backup monthly-and we only keep one copy of your latest backup on file. 

• Plugin Updates - and fixing of errors that updates causes

ENHANCEMENTS

During the maintenance period, if you desire the need to request that we develop any “enhancements” to the deliverables, we will exercise commercially reasonable efforts to prioritize our resources to create such enhancements. We ask that you understand that preexisting obligations to other clients on the date of your request may slightly delay the immediate execution of any such requested enhancements, however we will be happy to provide you with an additional time & cost proposal for any such requests.

50% RETAINER DEPOSIT UP FRONT

If you wish to secure our services we will need to set aside time for your project to be completed and to keep us from turning down or setting aside other paying work. We ask that a retainer deposit be made in advance before we begin any design to secure our obligation and expediency.

PAYMENTS SCHEDULE

[Remainder payment schedule to be set forth and solidified upon final agreement]Additional payments can be made to the total invoice upon reaching certain goals, milestones, or art approvals, depending on the nature of your project, we ask that you make yourself available to meet in person (or possible via web conferencing) to look over and discuss these factors and plan out all subsequent milestones and payments.

All invoices are payable upon receipt of invoice.

Wild Web Hosting & Designs will work to develop your website in maintenance mode, with a launch countdown or progress bar displaying outward to a test domain, or live domain. We will grant you and any project support representatives administrative access to the development through a user account so that you may view our progress and assist in uploading and editing content. Your website WILL NOT LAUNCH LIVE to the internet or be indexable to search engines or viewable to the general public if accounts are not current or overdue invoices are not paid in full.

LATE PAYMENTS

Please understand that a late payment may setback any agreed production schedules so prompt payment of any recurring or monthly invoicing notification is necessary to ensure our dedication to any agreed upon production goals and timelines commitments. In the event that you lack sufficient funding to secure timely payment, please make an effort to give us at least 3 days notice via a phone call or e-mail. A 1.5 percent daily service charge is payable on all overdue balances. Payments will be credited 1st to any accrued late payment fees and next to the unpaid balance. You shall be responsible for all collection or legal fees necessitated by late or default in payment. All grants of any license to use or transfer of ownership of any intellectual property rights under this agreement are conditioned upon receipt of payment in full which shall be inclusive of any and all outstanding additional costs, taxes, expenses and fees, charges or the costs of changes.

COPYRIGHTS

You guarantee to us that any elements of text, graphics, photos, designs, trademarks, or other artwork that you provide us for inclusion in the web site are either owned by your good selves, or that you have permission to use them.

You will be responsible for proof reading and approving all submitted text before publication. In the event that you approve deliverables but errors such as typographic errors, misspelling errors, or errors in grammar remain in the finished product, you shall incur any cost of correcting such errors or correct them at your own discretion.

When we receive your final payment, copyright is automatically assigned to you as follows: You will own the graphics and other visual elements that we create for this project. We’ll give you a copy of all the output files and you should store them safely as we are not required to keep them or provide any native source files we used to make them.

You also own text content, photographs and other data you provided, unless someone else owns them. In the event that we create custom photography for you, rights will be included in that project separately. We own the markup, CSS and other code and we license it to you for use on only this project. All Third Party Materials are the exclusive property of their respective owners. If any third party materials that you may be required to license are needed, we will inform you first and then obtain any license necessary to carry on. In the event you fail to properly secure any necessary license we will not be held liable of any damages, liabilities, costs, losses or expenses arising out of any claim, demand, or action by a third party arising out of your failure to obtain copyright, trademark, publicity, privacy, defamation or other releases or permissions with respect to materials included in the final design.

We love to show off our work and share what we have learned with other people, so we reserve the right to display and link to your completed project as part of our portfolio and to write about the project on web sites, in magazine articles and in books about web design.

DESIGNER AGENTS

Wild Web Designs shall be permitted to engage and/or use third party designers or other service providers as independent contractors in connection with the Services (“Design Agents”). Notwithstanding, Wild Web Designs shall remain fully responsible for such design agents’ compliance with the various terms and conditions of this agreement.

NO EXCLUSIVITY

The parties expressly acknowledge that this agreement does not create an exclusive relationship between the parties. You are free to engage others to perform services of the same or similar nature to those provided by Wild Web Designs and we are entitled to offer and provide design services to others, solicit other clients and freely advertise our services. You can’t transfer this contract to anyone else without our permission. This contract stays in place and need not be renewed. If for some reason one part of this contract becomes invalid or unenforceable, the remaining parts of it remain in place.

We submit your website to google search console for you. But that is all we do. Wild Wed Hosting 7 Designs is not responsible  for where your website ranks on google - or if it is not indexed by Google. If you need to fix this issues with google - there is extra fees for WILD web Hosting & Designs to troubleshoot and find the reason why, and to implement new SEO strategies to get your site indexed. You will be charged $30 per hour. Please contact support to get started.
